Have we kissed the Fourth Amendment goodbye?

The Democratic midterm campaign ads will write themselves.

Images of multiple masked government agents, decked out in tactical gear, weapons drawn, restraining an individual or “perp walking” someone half-naked from a house in the snow. They will show protesters, who look like average Americans, shouting and filming. These pictures are creating very negative voter perceptions and raising serious questions, even if the Trump administration did everything right.

If voters were appalled at images of immigrants flooding the southern border, they are just as appalled, maybe more so, at ongoing images of rough-and-tumble encounters with federal immigration enforcement.

The current focus is on the Minneapolis area, but news stories and protest marches are occurring in many other parts of the country.

When a confrontation occurs and social media erupts, the Trump administration and ICE officials immediately claim, before any investigation, that federal agents were completely justified in whatever actions they took. And they engage in character assassination of the individual involved in the altercation.
